Slip and Falls



In the area of ordinary negligence law, excluding medical malpractice and products liability, slip and fall cases are amongst some of the more difficult cases to win. As in any case, the injured party has an affirmative duty to prove negligence on the defendant. This includes proving the dangerous condition which caused your fall was either created by the defendant or his agents, or existed for a sufficient length of time that the defendant should have discovered and corrected the condition prior to your fall. This requires the plaintiff to prove how long the condition existed prior to the fall. This can create a very difficult hurdle to overcome. To assist your lawyer you should, or if you are unable someone with you should:

1. Take pictures of the condition, i.e., water, pot hole or other substance/condition, that caused your fall and the surrounding area;

2. If you can not take pictures, make observations of the condition/substance and the surrounding area;

3. Report the fall to the management of the premise; and,

4. Gather names, addresses and phone numbers of witnesses and employees of the location where you fell.
